Peter S. Kozinets

With an exceptional legal career spanning nearly three decades, Peter Kozinets brings unparalleled expertise in appellate advocacy, commercial and criminal litigation, media and constitutional law, intellectual property litigation, and civil rights matters.

Prior to joining Zwillinger Wulkan, Peter served as Senior Litigation Counsel at the U.S.  Attorney’s Office for the District of Arizona, where he handled high-profile appeals in the Ninth Circuit, advised, trained, and mentored Assistant U.S.  Attorneys, and earned recognition for outstanding oral advocacy.  Throughout his distinguished career, Peter has argued over 18 appeals, drafted more than 50 appellate briefs, and played pivotal roles in landmark trials and appeals involving misuse of the internet, money laundering, and child exploitation.

Peter remains deeply engaged in the legal community, serving in the State Bar of Arizona Appellate Section and the Sandra Day O’Connor Inn of Court.  His addition strengthens Zwillinger Wulkan’s reputation as a leader in high-stakes litigation and innovative legal solutions.

Experience

Peter’s extensive experience also includes his tenure at Steptoe & Johnson LLP, where he represented news organizations, journalists, and publishers in First Amendment, libel and defamation, public records, and other media law cases, as well as intellectual property and commercial litigation. His impressive academic credentials include graduating cum laude from Harvard Law School, where he was an Ames Moot Court Finalist, and magna cum laude from Harvard College.

Peter served as a judicial law clerk to the Hon. Roslyn O. Silver in the District of Arizona.

  • Awarded Certificate of Appellate Excellence in Oral Advocacy by the U.S. Attorney’s Office
  • Successfully prosecuted the owners and operators of a notorious website that marketed illicit services in more than 400 U.S. cities, generating a half-billion dollars in revenue; obtained guilty verdicts for crimes linked to sex trafficking, money laundering, and conspiracy; helped recover approximately $215 million in assets for victims; prevailed in four related appeals in the Ninth Circuit.
  • Successfully opposed effort to enjoin the broadcast of an investigative news report about tire safety, and successfully opposed application for a stay in the United States Supreme Court
  • Won affirmance in the Second Circuit of summary judgment in a trademark infringement case that involved guitar amplifier components; recovered attorneys’ fees.
  • Defended a False Claims Act qui tam lawsuit in Arizona federal court involving a defense contractor’s development of intellectual property, and prosecuted counterclaims for theft of trade secrets; prevailed on dispositive motions, won affirmance in Ninth Circuit, and recovered attorneys’ fees.
  • Litigated a class action challenging the Maricopa County Sheriff’s “crime suppression sweeps” in Latino communities; obtained spoilation-of-evidence sanctions against the Sheriff’s Office.  Melendres v. Arpaio, 2010 WL 582189 (D. Ariz. Feb. 12, 2010)
  • Drafted briefs resulting in ruling that officials’ work emails are subject to public inspection under the Arizona Public Records Law, unless they are solely “personal.”  Griffis v. Pinal County and Phoenix Newspapers, Inc., 156 P.3d 418 (Ariz. 2007)
  • Briefed and argued special action challenging voir dire closure in a murder-for-hire case.  Citizen Publishing Co. v. Hon. Nanette Warner, Bradley A. Schwartz and Ronald B. Bigger, 2 CA-SA 2006-0005 (Ariz. Ct. App. 2006)
