— Convinces U.S. Ninth Circuit Court of Appeals to Reverse & Remand Controversial Use of Force Case Back to Lower Court
On July 12th, 2023, Larry Wulkan appeared in front of the Ninth Circuit Court of Appeals, arguing that simply walking toward officers with a gun wasn’t enough to constitute deadly force, asking the justices to reverse summary judgment issued by a lower court.
Today, September 12th, 2023, the court weighed in with their response:
“Because, for the reasons explained above, a jury could conclude that the officers’ decision to shoot Rudhman was not objectively reasonable, we reverse the district court’s grant of summary judgment to Appellees on Appellants’ wrongful death claim.”
